1. Agreement to Terms

By accessing or using StonkHub ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

StonkHub provides stock market sentiment analysis and tracking tools, including:

• Aggregated sentiment data from public Reddit posts (r/wallstreetbets)
• Stock mention tracking and trending analysis
• Market data visualization and alerts
• Daily digest newsletters
• Premium features for paid subscribers

3. Not Financial Advice

• We do not recommend any specific investments or trading strategies
• Past performance does not guarantee future results
• You are solely responsible for your own investment decisions
• Always consult with a qualified financial advisor before making investment decisions
• Trading stocks involves substantial risk of loss and is not suitable for everyone

4. User Accounts

When you create an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Be at least 18 years of age

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Scrape, crawl, or spider the Service without permission
• Use automated tools to access the Service excessively
• Resell or redistribute our data without authorization
• Impersonate others or misrepresent your affiliation

6. Subscriptions, Payments, and Refunds

6.1 Billing

• Subscriptions are billed in advance on a recurring basis (monthly or yearly)
• You authorize us to charge your payment method automatically at each renewal period
• All payments are processed securely by Stripe. We do not store your credit card details

6.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price at each renewal. We will notify you by email at least 7 days before any price increase takes effect on your next renewal. You may cancel your subscription at any time through your account billing page.

6.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support at [email protected]. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are issued for unused time within a billing period.

6.4 Refund Policy

• Within 7 days of initial purchase: If you are unsatisfied with StonkHub, you may request a full refund within 7 days of your first subscription payment by emailing [email protected]
• After 7 days: Refunds are provided at our discretion on a case-by-case basis
• Renewal charges: If you forgot to cancel before a renewal, contact us within 48 hours of the charge for a full refund of that renewal period
• EU/EEA/UK users: Under the EU Consumer Rights Directive, you have a 14-day right of withdrawal from the date of purchase. By using the service during this period, you acknowledge that you may lose this right for the current billing period

6.5 Price Changes

Prices are subject to change with at least 30 days' written notice. Price changes will not affect your current billing period. For users in the EU/EEA/UK, price increases require your explicit consent before being applied to your subscription.

7. Assumption of Risk

• You understand that StonkHub provides sentiment analysis tools and algorithmic outputs, not investment advice or recommendations
• You will not rely solely on StonkHub data or signals when making investment decisions
• You assume full responsibility for any trading decisions you make, whether or not influenced by information obtained through StonkHub
• You waive any and all claims against StonkHub for investment losses resulting from your use of the platform, to the fullest extent permitted by applicable law
• You acknowledge that past performance of any signal, alert, or prediction displayed on StonkHub does not guarantee future results

8. Intellectual Property

The Service and its original content, features, and functionality are owned by StonkHub and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9. Third-Party Content

Our Service displays content from third-party sources including Reddit, stock exchanges, and financial data providers. We do not control, endorse, or assume responsibility for this content. Use of third-party content is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for any investment losses you may incur
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless StonkHub, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions that should survive termination shall survive.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing any formal proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

13.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, and judgment on the award may be entered in any court with jurisdiction.

13.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

13.4 Exceptions

This arbitration agreement does not apply to: (a) disputes that qualify for small claims court; (b) actions to enforce intellectual property rights; or (c) where prohibited by applicable law (including EU/EEA/UK consumer protection laws that guarantee access to courts).

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions.
